JetBlue Sued After Passenger Dies Following Alleged Stroke Inflight

The estate of John Allen Fletcher has initiated a wrongful death lawsuit against both JetBlue Airways and ABM Aviation following his tragic passing after a flight to Palm Beach International Airport (PBI). The lawsuit alleges that cabin crew overlooked clear signs of a stroke upon landing and that airport personnel failed to provide timely medical assistance, allowing Fletcher’s condition to deteriorate into a medical emergency.

Fletcher’s family contends that he was left unattended and in distress after the flight, which originated from Boston, Massachusetts, on April 22, 2025. They claim that the airline’s staff requested a non-emergency wheelchair attendant from ABM Aviation to remove him from the aircraft, abandoning him in a baggage area until discovered by family members. The family alleges that an ABM employee refused to call emergency services when asked, stating, “we’re not allowed to do that,” according to reports from Boca News Now.

Incident Details and Legal Claims

The lawsuit details that Fletcher, who was seated in a premium section of the aircraft, appeared healthy when he boarded. After Flight 321 landed, he reportedly suffered a major stroke as he stood up. Witness accounts indicate that he exhibited garbled speech while attempting to attract the attention of nearby passengers. One fellow traveler alerted cabin crew but asserts that no action was taken to assist Fletcher, despite his evident distress.

Instead of prioritizing medical help, the crew allegedly waited until all other passengers deplaned before requesting non-emergency assistance. The family asserts that this delay ultimately contributed to the tragic outcome, as Fletcher remained in distress for over an hour before medical personnel arrived to transport him by ambulance to St. Mary’s Hospital. He passed away on May 5, 2025, after spending 13 days in the hospital due to the severe effects of the stroke.

The family argues that both JetBlue and ABM Aviation failed to adhere to established protocols for recognizing and responding to strokes, treating Fletcher as an “inconvenient obstacle” rather than a patient in need of urgent care. The lawsuit states, “As all the other passengers deplaned, Mr. Fletcher was physically unable to rise and remove himself from the aircraft and remained sprawled across the seats in row 2 in full view of JetBlue’s crew.”

Legal Implications and Airline Responsibilities

Airlines have a legal obligation to provide reasonable medical assistance to passengers. While crew members are not required to be medical professionals, they must exercise due care to ensure passenger safety. The Federal Aviation Administration (FAA) mandates that cabin crew receive training in first aid, CPR, and the use of Automated External Defibrillators (AEDs). Failure to take appropriate action during a medical emergency could be considered negligence.

Legal experts note that if an airline neglects to follow standard procedures or ignores a clear need for assistance, it may be held liable for damages. The law office of Morrow, Morrow, Ryan, Bassett & Haik emphasizes that ignoring a passenger’s medical needs could constitute an act of negligence. Airlines and their crew typically enjoy liability protection for actions taken during emergencies, provided they do not engage in gross negligence or willful misconduct.

As the case unfolds, it raises critical questions about the responsibilities of airlines and the standards of care expected during medical emergencies in-flight. The family of John Allen Fletcher seeks accountability and justice for what they describe as a preventable tragedy.
